Written to be read. These are the actual terms between you and 5Kaizen.
You pay a monthly subscription. We build and run your real estate website and marketing studio. Your content, your leads, and your client records are yours — when you leave, they leave with you. You're responsible for what you publish. We don't guarantee leads, rankings, or income. Either of us can end it with notice. Details below.
5Kaizen provides website hosting, content tools (including AI-assisted writing, image generation, and video editing), lead capture, CRM features, automated market reports, and — on the Coaching+ tier — recurring coaching sessions. Tier features and prices are listed on the pricing page and may evolve; material reductions to a tier you're paying for will be communicated in advance.
Subscriptions bill monthly in advance. You can cancel anytime, effective at the end of the current billing period — no long-term contracts, no cancellation fees. A one-time build/onboarding fee, if applicable to your plan, is quoted before you commit. Fees are not refundable once a billing period has begun, except where required by law.
You own your content (posts, photos, videos, bio), your leads, and your CRM records. You grant us a license to host, process, display, and back up that content solely to operate the service. On cancellation, we'll provide an export of your content and records on request, then delete our copies per the Privacy Policy. We own the platform: the software, templates, designs, and systems remain 5Kaizen's property.
The platform drafts content (blog posts, reports, images, emails) using AI, tuned to your voice and market. AI output can contain errors. You are the publisher: you're responsible for reviewing content before it goes out under your name, and for ensuring everything you publish complies with your MLS rules, brokerage policies, REALTOR® Code of Ethics, fair-housing law, and Florida real estate advertising regulations. Automated publishing features (like the weekly market report) can be set to require your approval — if you choose fully automatic mode, you accept responsibility for what's published.
Don't use the platform to publish unlawful, deceptive, discriminatory, or infringing content; to spam; or to misrepresent your licensure or production. We may suspend accounts that put other clients or the platform at legal risk, with notice when practicable.
You confirm you hold an active real estate license where you do business and that the information you give us for your site (license number, production claims, testimonials) is accurate. You'll keep your contact and billing info current.
We build you serious tools and we'll tell you honestly how to use them — but we do not guarantee leads, closings, search rankings, traffic, or income. Real estate results depend on your market, your effort, and factors nobody controls. Anything on this site describing results (dashboards, examples, agent stories) is illustrative — see Disclosures.
Coaching+ sessions are business mentoring from a working real estate professional. They are not legal, financial, tax, or brokerage-compliance advice, and they don't create an employment, team, or brokerage relationship between you and 5Kaizen or Momentum Realty.
We target high availability using Cloudflare's global infrastructure, but no service is uninterrupted. Scheduled maintenance and third-party outages happen. Our liability for downtime is limited to service credits at our discretion.
To the maximum extent permitted by law, 5Kaizen's total liability for any claim arising from the service is limited to the amount you paid us in the three months before the event giving rise to the claim. We're not liable for indirect, incidental, or consequential damages, including lost commissions or lost business.
You can cancel anytime from your account or by emailing chris@5kaizen.com. We can terminate with 30 days' notice (or immediately for material breach). Either way, you get your data export.
These terms are governed by Florida law. Disputes will first be attempted in good faith directly; failing that, individual binding arbitration in Duval County, Florida — no class actions, where permitted by law. Nothing here waives rights that can't be waived by contract.
